H-1B or H1B Visa

An H-1B or H1B visa is a work visa that is available to alien employees that will be hired in specialty occupations in which a Bachelor, its equivalent or higher degree is normally a minimum requirement.

The specific duties must be deemed so specialized and complex that the knowledge to perform such duties is associated with a specific type of bachelor or higher degree.

The employer must file a Labor Condition Application (LCA) with the U.S. Department of Labor Employment and Training Administration. The LCA certifies the rate of pay, period of employment and work location. An LCA is a prerequisite to the H1B Petition for a Nonimmigrant Worker.
